This notice applies to:

  • Candidates who apply for or express an interest in a vacancy managed by KDC
  • Individuals who ask to join the KDC talent pool
  • Individuals KDC identifies and contacts about a potentially relevant opportunity
  • Candidates introduced or considered for a client vacancy

This notice explains how KDC collects, uses, shares, stores and protects your personal information.

Information we may collect

Depending on the recruitment service and vacancy, KDC may collect:

  • Your name and contact details
  • Your CV, employment history and career information
  • Your qualifications, professional registrations and relevant training
  • Your current or most recent position and employer
  • Your salary or remuneration information and expectations
  • Your notice period and availability
  • Your location, travel preferences and preferred working arrangements
  • Your career interests and role preferences
  • Information you provide during registration and screening conversations
  • Evidence of your experience against an agreed role specification
  • Interview availability, progress, feedback and recruitment outcomes
  • Records of your permission to be represented for a particular vacancy
  • Information about previous applications or agency representation
  • Public professional information relevant to a potential opportunity
  • The source and date on which publicly available information was obtained
  • The status of any checks relevant to a vacancy

KDC aims to collect only the information reasonably necessary for recruitment and selection.

Special category and criminal offence information

KDC does not routinely request information about your health, ethnicity, religion, sexual orientation, trade union membership or other special category information.

You may choose to provide relevant health or adjustment information where this is necessary to support an accessible recruitment process. Where KDC needs to process special category information, we will identify an appropriate legal condition and provide any additional information required.

KDC does not routinely conduct criminal record checks as part of its standard permanent search service. If a role requires a criminal record or other regulated check, the responsibility for completing that check will normally remain with the prospective employer unless KDC agrees otherwise in writing.

Where we obtain information from

KDC may receive information:

  • Directly from you
  • From a prospective employer or client organisation
  • From a person who refers or recommends you
  • From referees or former employers where you have authorised contact
  • From publicly accessible professional sources, including professional profiles, company websites, published articles, speaker biographies, professional directories and registers
  • From authorised business and professional contact databases
  • From recruitment, communication and technology providers used to deliver the service

Where KDC obtains your information from another source, we will provide access to this notice within a reasonable period and no later than required by data-protection law. Where we contact you about an opportunity, we will normally provide this notice with or before our first communication.

How we use your information

KDC may use your information to:

  • Assess your potential suitability for a vacancy
  • Compare your experience with an agreed client Role Brief
  • Contact you about a relevant opportunity
  • Conduct a structured screening conversation
  • Prepare an evidence-based candidate summary
  • Present you to a client after obtaining the required vacancy-specific permission
  • Arrange interviews and communicate recruitment updates
  • Record recruitment decisions and feedback
  • Avoid duplicate applications or candidate introductions
  • Maintain appropriate recruitment, consent and audit records
  • Manage successful introductions and placement fees
  • Respond to questions, rights requests or complaints
  • Establish, exercise or defend legal claims
  • Meet legal, regulatory and professional obligations
  • Keep you in the KDC talent pool where you have asked us to do so

Our lawful bases

KDC relies primarily on legitimate interests when identifying, contacting, assessing and matching potential candidates with genuine employment opportunities.

These legitimate interests include:

  • Helping clients identify suitable candidates
  • Helping candidates access potentially relevant opportunities
  • Operating an effective and evidence-led recruitment service
  • Maintaining appropriate records of candidate introductions and recruitment activity
  • Protecting KDC, its clients and candidates from duplicate or unauthorised representation

Before relying on legitimate interests, KDC considers whether the processing is necessary and whether your interests, rights or reasonable expectations override those interests.

KDC may also process information:

  • To comply with a legal obligation
  • With your consent, where consent is the appropriate basis
  • To establish, exercise or defend legal claims
  • To take steps you have requested in connection with a recruitment opportunity

You may withdraw consent at any time where processing relies on consent. Withdrawal will not affect processing that was lawful before consent was withdrawn.

Talent pool

Joining the KDC talent pool is optional.

If you ask KDC to retain your information for future opportunities, we may contact you when a role appears reasonably relevant to your experience and stated preferences.

You can leave the talent pool at any time by emailing Kayleigh@dobsonconsulting.co.uk.

Choosing not to join the talent pool will not affect your consideration for a vacancy for which you have already applied or given representation permission.

Candidate representation

KDC will not send your CV or Candidate Evidence Pack to a prospective employer without an appropriate basis and vacancy-specific permission to represent you.

Your permission to be represented for one vacancy does not automatically authorise KDC to submit you for unrelated vacancies.

When your information is supplied to a prospective employer, that organisation will normally become an independent data controller responsible for its own use of your information. It should provide you with its own privacy information where required.

Digital and AI-assisted tools

KDC may use digital tools, including AI-assisted tools, to help organise, search, compare or summarise recruitment information.

KDC does not use solely automated decision-making to decide whether you should be appointed. Candidate screening and shortlist recommendations involve human review, and the prospective employer remains responsible for its own interview and final employment decision.

Information produced using digital tools is reviewed before it is relied upon or shared with a client.

Who we may share information with

KDC may share relevant information with:

  • A prospective employer after the appropriate representation process
  • Technology, CRM, email, document-storage and website providers supporting the service
  • Professional advisers, including legal, insurance, accounting and compliance advisers
  • Regulators, courts, law-enforcement bodies or public authorities where disclosure is required or permitted by law
  • Another party where necessary to establish, exercise or defend legal rights

KDC does not sell candidate personal information.

Service providers acting on KDC’s behalf may access information only to provide their contracted services and must handle it appropriately.

International processing

Some technology providers may process or store information outside the United Kingdom.

Where this occurs, KDC will take reasonable steps to ensure that an appropriate legal safeguard is in place, such as UK adequacy regulations, an approved international data-transfer agreement or another lawful transfer mechanism.

How long we retain information

KDC applies the following general retention periods:

  • Information relating to an unsuccessful application or recruitment process is normally retained for up to 12 months after the last relevant recruitment activity.
  • Talent-pool information is normally retained for up to 12 months from your most recent permission or meaningful contact. KDC may ask whether you want your information to be retained for a further period.
  • Records relating to a successful placement, candidate introduction, contractual transaction or placement fee may be retained for up to six years after the relevant placement or transaction.
  • Information required for a legal obligation, complaint, dispute or legal claim may be retained for longer where reasonably necessary.

At the end of the applicable period, information will be securely deleted or anonymised unless there is a lawful reason to retain it.

If you do not provide information

You are not legally required to provide information to KDC.

However, if you do not provide information needed to assess your experience, communicate with you or obtain representation permission, KDC may be unable to consider or introduce you for a vacancy.

Your data-protection rights

Depending on the circumstances, you may have the right to:

  • Ask for access to the personal information KDC holds about you
  • Ask for inaccurate or incomplete information to be corrected
  • Ask for your information to be deleted
  • Ask KDC to restrict how your information is used
  • Object to processing based on legitimate interests
  • Receive certain information in a portable format
  • Withdraw consent where processing relies on consent
  • Ask for information about the sources from which your data was obtained
  • Raise a complaint about how your information has been handled

These rights do not apply in exactly the same way in every situation. KDC will explain if a requested right does not apply and why.

KDC will acknowledge a data-protection complaint within 30 days and will investigate and respond without undue delay. We will keep you informed if further time is reasonably required.
